SELECTMEN’S MEETING

November 13, 2018

5:00pm

1. APPROVAL OF AGENDA:

Selectmen Elise Miller made a motion to approve the agenda; seconded by Selectmen Kimberly Stacey-Horn. No discussion. All in favor. Agenda approved.

2. MINUTES OF LAST MEETING:

Selectmen Elise Miller made a motion to approve the minutes for November 7, 2018; seconded by Selectmen Kimberly Stacey-Horn. No discussion. All in favor. Minutes approved.

3. DEPARTMENT HEAD / COMMITTEE CHAIR UPDATES:

David Langley approached the Board to give an update on District 2 Road work:

  • New Bridge Road - Tree work has been started. When crew finishes there, they will move over to Hopper Road.

  • Hopper Road - # cross ditches were done using 6 ton of materials; crew then went to New Bridge Road and laid 2 ton of material to finish it off.

  • Roof concerns – Mr. Langley is in the process of following up with telephone calls made and getting information of repairs. The project is now on the list and the agenda.

  • New County Road and Milton Mills Road junction has a plugged culvert. Mr. Langley is in the process of getting equipment to clear the culvert. The road is closed until that can be achieved as there is 4” of water covering the road. Notices, signs, barricades have all been appropriately posted.

  • Mr. Langley informed the Board that there was 2,000 lbs of sand put up into the Sand Shed.

  • Selectmen Miller asked Mr. Langley for an update on the guardrail situation on Rowe Bridge. Mr. Langley was unfamiliar with the issue. Selectmen Stacey-Horn indicated that this issue was being handled by Road Commissioner Scott Mooney and the Board would need to follow up with Mr. Mooney for an update.

    4. OLD BUSINESS:

    A. Generator Bids

    The proposal and the $8800 for the approved generator doesn't include any of the installation and digging. The Town Administrator is seeking more information and quotes for this work.

    B. ACO Position

    The Board commented in previous meeting that if the lack of applying for the ACO position is due to the money to please step up and say something. With that thought in mind, the Town Administrator reached out to a few people who are on the fence to see if that was their reason. Current stipend is $432/month. With the Boards approval, an increase to the stipend will be presented to be voted on at the Special Town Meeting and then hopefully someone will apply based on that. The Town does get these calls and definitely needs an ACO.

    C. Town Report

    The Town Administrator indicated that the Town Report was about 75% completed; expects to have the draft to the Board by the end of the week.

    D. D6 Dozer

    Selectmen Walsh is still working on this item.

    E. 13th Street

    Removing from the agenda. The issue has been scheduled with the Zoning Board of Appeals. With the Town as a party involved in the appeal, the Board can not continue to work on this item.

    5. NEW BUSINESS:

    A. Executive Session M.R.S.A 405 Section 6.A.

    Selectmen Miller made a motion to go into Executive Session M.R.S.A. 405 Section 6.A.; seconded by Selectmen Stacey-Horn. All in favor. The Selectmen and Town Administrator went into Executive Session at 5:11 pm.

    The Selectmen and Town Administrator returned from Executive Session at 5:31 pm. Selectmen Miller made a motion for the Board to return from Executive Session; seconded by Selectmen Stacey-Horn. All in favor. The Board continued the Board of Selectmen meeting.

    B. ZBA and Warrant & Fiance Appointments

  • Susan Meehan is willing to serve on the Warrant & Finance Committee to replace Lois Michaud as an alternate member. Selectmen Walsh read out appointment. Selectmen Miller made a motion to appoint Susan Meehan as Warrant & Finance Committee Alternate Member until June 30, 2020; Selectmen Stacey-Horn seconded. Motion passed. Board signed appointment.

  • Zoning Board of Appeals Appointees are: Bob Anderson and Dennis Long III – Regular Members; Brandi Cenecal and Brian Gleason – Alternate Members. Appointments were done in groups. Selectmen Miller made a motion to appoint Bob Anderson and Dennis Long III as Regular Members of the Zoning Board of Appeals until June 30, 2021; Selectmen Stacey-Horn seconded. Motion passed. Board signed appointments. Selectmen Miller made a motion to appoint Brandi Cenecal and Brian Gleason as Alternate Members for the Zoning Board of Appeals until June 30, 2021; Selectmen Stacey-Horn seconded. Motion passed. Board signed appointments.

  • The Town Administrator commented that the ZBA now has a full Board and their next meeting will be on Thursday for informational purposes.

    C. Special Town Meeting Warrant

    The Town Administrator read out the Warrant Article to be voted on at the Special Town Meeting. Selectmen Miller made a motion to sign the Warrant to be presented at the Special Town Meeting on November 26th; seconded by Selectmen Stacey-Horn. All in favor. Board Members signed Warrant Article.

    The Town Administrator commented that the Warrant Article has to be posted by November 19th. Posting without recommendations which can be applied at a later date.

    D. Local Option Election in a Municipality

    The Town Administrator updated the Board that the State wanted proof that the Town voted to allow the sale and consumption of liquor on Sundays. No proof was found. A petition must be received signed by 15% of voters to present this article at a Special Town Meeting. The Town would then vote and provide the State the proof it requires to allow establishments to continue operating as is.

    E. Security of Sand / Salt Shed
    Selectmen Miller after Road Committee meeting asked that this item be added to the agenda to be looked at regarding the procedures for securing the Sand and Salt Shed buildings. Can be tabled until Road Commissioner in District 2 is in place. The Town Administrator will speak to the Road Commissioners and schedule this.

    David Langley approached the Board to explain incident when doors were left open. This was to accommodate the delivery of late night sand delivery. The issue is being worked on.

    F. Lakeside Drive (Article 43)

    The Road Committee made a recommendation for application submitted. The Board accepted the recommendations and approved the application with a $3,000 cap. Selectmen Miller made a motion to approve the application for Lakeside Drive Road Association for Article 43 regarding 23 M.R.S.A Section 3106 for up to $3,000; seconded by Selectmen Stacey-Horn. All in favor. Motion carried. Packet was signed.


    G. District 2 Road Commissioner

    Selectmen Walsh read out the appointment to extend David Langley's Interim Road Commissioner position until November 30, 2018. Selectmen Miller made a motion to appoint David Langley as Interim Road Commissioner until November 30, 2018; Selectmen Stacey-Horn seconded. Motion passed. Board signed appointment.

    Selectmen Walsh announced the appointment of a new District 2 Road Commissioner to Joseph Letourneau. Selectmen Walsh read out the Mr. Letourneau's appointment as District 2 Road Commissioner until June 30, 2021. Selectmen Miller made a motion to appoint Joesph Letourneau as District 2 Road Commissioner until June 30, 2021; Selectmen Stacey-Horn seconded. Motion passed. Board signed appointment. The Board introduced Mr. Letourneau who stood up and thanked everyone for the support in his new appointment.

    6. PUBLIC COMMENT:

    Joe Ruma approached the Board to ask Winchell Sr. the status of the Town owned property known as the D6 at the Fairground. Selectmen Walsh said it was still sitting at the Acton Fairgrounds and awaiting a spot to be build to allow it to be on displayed. Mr. Ruma thought that it should be appraised. Mr. Ruma and Dennis Long asked if all the Town owned equipment was returned from Mr. Winchell. Mr. Long indicated not all equipment has been returned. The Board responded that they will obtain a list and follow up on said list.

    Mr. Long also asked the Board an update on snow plowing decision. The Board decided that by appointing a Road Commissioner tonight, that Road Commissioner will assume all plowing and District 2 responsibilities and duties.

    The Town Administrator told the Board the small piece of road on Lebanon Road is being looked at to see if Shapleigh will pick it up or stay in District 2.
