TOWN OF ACTON

SELECTMEN’S MEETING

DECEMBER 5, 2006

 

1. PUBLIC FORUM:

 

Mike Long told selectmen that since he has not received the answers he requested that selectmen get from MMA, he has decided to withhold the tape of the Flat Ground Road Association meeting from the selectmen.

Dennis Long read the following statement: "I would like to clear up some of the misconceptions and answer the false accusations made about me at the 11/21/06 meeting. I did not make the report to MSHA. However, as an elected official, I am considered by law to be a "town employee". Therefore, I am covered by the Whistleblowers Act and the town cannot seek retaliation against me or have me removed from my position based on any so-called "code of ethics". Again, I want to reinforce that I absolutely did not report the town to MSHA. This personal vendetta that some town officials have against me needs to stop. The selectmen have an obligation not to allow that kind of behavior at a public meeting. People are making decisions based on emotions, personal feelings, and opinions of uninformed people instead of facts. The behavior of the town officials at the 11/21/06 meeting was unacceptable and I expect an apology from the Board of Selectmen as well as the Chairmen of the Road Committee, David Cote." Dennis requested that his letter be written into the minutes. Nancy said she would consider a written apology. Jim said it was not the reporting, it was the fact that MSHA was given false information. Ron Crawford announced that he was the one that reported the gravel extraction operation to MSHA. Jim said MSHA said there was nothing wrong with the operation at the school and they were angry that they were called in and given inaccurate information. Davey Winchell stated Ron called for the protection of the Town. Davey also said he was concerned that the Town is not conducting a drug testing program for Town employees. All the fire truck drivers should be included as well as the road crews.. Nancy said both Road Commissioners and their drivers are covered by drug testing programs.

The treasurer reports that at this time there are 6 properties due for automatic foreclosure on 12/8/06.

On a motion by Tony it was voted to adopt the following amendment: Article XVI - PERFORMANCE APPRAISALS. Employee performance evaluations are a tool designed to facilitate communications between employee and employer about employee performance on the job. Performance appraisals will be conducted by the employee’s immediate supervisor, normally members of the Board of Selectmen or department heads, after a six month probationary period, for employees entering new positions and annually thereafter. The written evaluation will become a part of the employee’s personnel file and be used as a tool to set performance goals and to determine if raises are merited.

 

(B) SMALL CLAMS AUTHOTRIZATION:

On a motion by Tony, selectmen signed a letter authorizing Jennifer Roux to represent the Town is small claims action regarding 2004/2005 real estate taxes on which liens were not filed.
