TOWN OF ACTON SELECTMEN’S MEETING
July 8, 2021

4. APPROVAL OF AGENDA

Selectmen Ed Walsh made a motion to approve the agenda as written; seconded by Selectmen Kimberly Stacey-Horn. No discussion. All in favor.

5. MINUTES OF LAST MEETING  - Tabled

6.         DEPARTMENT HEAD / COMMITTEE CHAIR UPDATES - None

7. OLD BUSINESS

A. Canal Road Bean Contract

The Town Administrator informed the Board that work was spent last week with Mr. Bean and the Town’s Attorney to arrive at an agreed upon document. For the public’s information, changes noted were:

· The sentence, “Contractor warrants that the contractor’s work shall be free of defects and completed in a workman like manner; all work will be completed in accordance with the engineer drawings which will be provided by the Contract” was left in the contract.

· On the second page, a line was added which read, “ All work performed by Michael Bean shall be guaranteed for one year from date of completion.

· A clause was put at the bottom under the payments that stated,“ If any additional work is needed which is not included in the total base bit, it must be approved in advance with a signed change order by the Town of Acton Board of Selectmen and contractor.

· The Town Administrator also added a place for the Board of Selectmen Chair to initial each page in lieu of a signature.

Mr. Bean has signed this contract and the only item left is for the Board to make a motion.

Selectmen Ed Walsh made a motion to sign the contract with M.A.Bean and Associates, LLC to replace the bridge on Canal Road for a grand sum of, total bid price, $217,000 making Acton’s payment as $108, 500; seconded by Selectmen Kimberly Stacey-Horn. No discussion. All in favor.

8. NEW BUSINESS

A. Appointments

At the last Board of Selectmen’s meeting, Bernard Broder III was discussed to move from a Planning Board Alternate Member to a Planning Board Member but was not read off in the list. For transparency, the Board will make a motion this evening.

Selectmen Kimberly Stacey-Horn made a motion to appoint Bernard Broader as a Planning Board Member pursuant of Title 30A §2602 effective until 6/30/2022; seconded by Selectmen Ed Walsh. No discussion. All in favor.

Selectmen Kimberly Stacey-Horn made a motion to appoint Brandy Senecal and Yoli Gallagher as Zoning Board of Appeal Alternate Members pursuant of Title 30A §2602 effective until 6/30/2022; seconded by Selectmen Ed Walsh. No discussion. All in favor.

Selectmen Kimberly Stacey-Horn made a motion to appoint Jannell Zarba, Don Kearney and Kelly Collins as Mary Grant Committee Members pursuant of Title 30A §2602 effective until 6/30/2022; seconded by Selectmen Ed Walsh No discussion. All in favor.

Selectmen Kimberly Stacey-Horn made a motion to appoint Carol Ward as Recreation Committee Members pursuant of Title 30A §2602 effective until 6/30/2022; seconded by Selectmen Ed Walsh. No discussion. All in favor.

Selectmen Kimberly Stacey-Horn made a motion to appoint Thomas McGurty to the Capital Improvement Committee pursuant of Title 30A §2602 effective until 6/30/2022; seconded by Ed Walsh. No discussion. All in favor.

Discussion ensued regarding the number of Committee member on the Capital Improvement Committee; outcome was the more the better.

B. H Road Speeding
Selectmen Ed Walsh brought this topic to the Board to discuss as he was approached by a local resident Mr. John Short with concerns. Mr. Short’s concerns were the speed of large trucks such as a dump truck speeding on H Road down the hills leaving skid marks when needing to brake quickly. Mr. Short indicated that as he entered H Road a tractor trailer truck had to slam on his brakes to avoid an accident with Mr. Short who was pulling a horse trailer. There is a slight blind turn at this location; any truck moving at 50 mph would catch up to that turn quickly. Local law enforcement if not effective, it is DOT that puts the scare into the bigger rigs.  Discussion ensued. The Board recommended that the speed limit sign be put into place as a start and contact the local trucking companies to bring this to their attention. Final alternative discussed was stripping a double line to force a slow down. The Town Administrator will start to make calls.

9. PUBLIC COMMENT

Joyce Bakshi approached the Board to indicate that a new subdivision is opening in Shapleigh and will impact the H Road with regards to speeding because they can’t turn around and are backing in. Discussion ensued regarding this is a traffic hazard and recommend that Mrs. Bakshi call it in. Further discussion ensued regarding these roads are not posted and thus are used frequently. If there are further issues, they will be addressed at that time.
